Information on Terms of Use

ACCEPTANCE OF TERMS

By using the services provided by Enquiro Search Solutions Inc. you are agreeing to be subject to the following Terms of Use ("TOU"). Enquiro Search Solutions reserves the right to update the TOU at any time without notice to you. The most current version of the TOU can be reviewed by clicking on the "Terms of Use" hypertext link located at the bottom of our Web pages.

DESCRIPTION OF SERVICES

Through its network of Web properties, Enquiro Search Solutions provides you with access to a variety of resources (collectively "Services"). The Services, including any updates, enhancements, new features, and/or the addition of any new Web properties, are subject to the TOU.

SCOPE OF GRANT

The Services provided are for your personal or your internal enterprise use.

You may:

(a) modify, copy, distribute, transmit, display information obtained from the Services.

You may not:

(a) reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or Services obtained from the Services;

(b) permit concurrent use of the software;

(c) modify, translate, reverse engineer, de-compile, disassemble or otherwise attempt to discern the source code of all or any portion of the software (except to the extent of applicable laws), or create derivative works based on the software;

(d) sell, rent, lease, grant a security interest in, sublicense, distribute or otherwise transfer rights to the software.

MEMBER ACCOUNT, PASSWORD, AND SECURITY

If any of the Services requires you to open an account, you must complete the registration process by providing us with current, complete and accurate information as prompted by the applicable registration form. You also will choose or be assigned a password and a user name. You are entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for any and all activities that occur under your account.

Only the account holder will have access to the account. However, Enquiro technical support services may access the account if the account holder requests technical support.

You agree to notify Enquiro Search Solutions immediately of any unauthorized use of your account or any other breach of security. Enquiro Search Solutions will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by Enquiro Search Solutions or another party due to someone else using your account or password. You may not use anyone else's account at any time, without the permission of the account holder.

PRIVACY

Collection of Your Personal and Web Site Information:

Personal information will be collected as part of the signup process, such as your e-mail address, name, home or work address or telephone number.

Web site information will be collected in order to provide you with reports, such as your site ranking, keywords on your site, number of visitors and visitor origin, your competitors names and domains.

Enquiro may also keep track of the usage statistics of our customers, and certain information about your computer hardware and software (such as IP address, browser type, domain names, access times and referring web site addresses) in order to improve the services provided to our customers.

Use of your Personal and Web Site Information:

Enquiro may, from time to time, use your personal information to contact you to inform you of other products or services available from Enquiro. Enquiro may also contact you via surveys to conduct research about your opinion of current services or of potential new services that may be offered.

Enquiro may include your web site information in aggregate data to conduct marketing and technical research designed to improve our products. Your data will never be used in such a way where either you or your web site would be identifiable.

Enquiro does not sell, rent or lease its customer lists to third parties. We occasionally hire other companies to provide limited services on our behalf, such as handling the processing and delivery of mailings or surveys, processing transactions, or performing statistical analysis of our services. We will only provide those companies the personal information they need to deliver the service. They are required to maintain the confidentiality of your information and are prohibited from using that information for any other purpose.

PROPRIETARY RIGHTS

You acknowledge and agree that, other than the license granted to you in the Agreement, the copyright, patent, trade secret, and all other intellectual property and proprietary rights of whatever nature in the software, are and shall remain the property of Enquiro Search Solutions.

LIMITATION OF LIABILITY

The User shall not be entitled to claim, directly or indirectly, any loss, damage or expense of any nature or kind whatsoever, including direct, indirect, consequential, exemplary, incidental, (including lost revenue, profit or goodwill), or any other form of compensation from Enquiro Search Solutions, or its agents, directors, officers, employees, subsidiaries or affiliated companies, whether such claim is based on a cause of action in tort or in contract (including, but not limited to, fundamental breach of contract) arising from or related to the use or performance of software, documents, provision of or failure to provide Services, or information provided from the Services.

The User acknowledges that search engines change their criteria and policy for ranking sites constantly and Enquiro Search Solutions will not be responsible for any loss or damage, direct or indirect, as a result of the User’s sites not being ranked, or not being ranked higher. Enquiro Search Solutions gives no guarantees or warranties whatsoever regarding the ranking and positioning of the User's sites, and all conditions and warranties related thereto, directly or indirectly, are hereby excluded.

Enquiro Search Solutions is not responsible for any data or other information available from a third party web site and you acknowledge that Enquiro Search Solutions shall have no liability to you for any damage or loss arising from the access to, use of, or reliance on such data or information.

ACCURACY OF RESULTS

Some search engines have geographically-scattered data centers that are not completely synchronized. To ensure the highest accuracy possible, SEI Reports randomly queries these various data centers for rankings. Results may vary slightly from your manual searches if the data center queried is different from your local default data center.

MODIFICATIONS

The dynamic and changeable nature of the Internet may mean that the features of the software may change from time to time in relation to which search engines, directories, or related features are supported and to the extent they are supported in the software. Support for certain search engines or directories may be added or removed at the discretion of Enquiro Search Solutions.

WARRANTY

This software is being provided on an "AS IS" basis, without any express or implied warranty. Enquiro Search Solutions specifically disclaims the implied warranties of the merchantability of this software or its fitness for any particular purpose.

SUPPORT

Software customers are provided with free support. This support will be governed by the current support policies of Enquiro Search Solutions. If the software is discontinued, Enquiro Search Solutions reserves the right to limit the product support and updates for the discontinued product to a reasonable time after its discontinuation.

Enquiro Search Solutions reserves the right to discontinue free support with 90 days written notice posted to their web site.

TERMINATION AND RESTRICTION OF ACCESS

This agreement and the license granted herein shall remain in effect perpetually. However this agreement and the license will terminate automatically if you fail to comply with the terms and conditions described herein.

Enquiro Search Solutions reserves the right, in its sole discretion, to terminate your access to free Services at any time, without notice.

Enquiro may also terminate or suspend your access to free Services for inactivity, which is defined as failing to sign in to the Services for an extended period of time, as determined by Enquiro. Upon termination of your account, your right to use the free Service immediately ceases.

NO UNLAWFUL OR PROHIBITED USE

As a condition of your use of the Services, you will not use the Services for any purpose that is unlawful or prohibited by these terms, conditions, and notices.

You may not:

(a) use the Services in any manner that could damage, disable, overburden, or impair any Enquiro Search Solutions server, or the network(s) connected to any Enquiro Search Solutions server, or interfere with any other party's use and enjoyment of any Services.

(b) gain or attempt to gain unauthorized access to any Services, other accounts, computer systems or networks connected to any Enquiro Search Solutions server or to any of the Services, through hacking, password mining or any other means.

(c) obtain or attempt to obtain any materials or information through any means not intentionally made available through the Services.

YOUR INFORMATION

In order to use the Services, Enquiro Search Solutions requires that you provide certain personal information, such as name, company and email address.

You agree to:

(a) provide true, accurate, current and complete information about you as prompted by the applicable forms;

(b) maintain and promptly update the information.

If you provide any information that is false, inaccurate, not current or incomplete, or Enquiro Search Solutions has reasonable grounds to suspect that such information is false, inaccurate, not current or incomplete, this will constitute failure to comply with the terms and conditions of the Terms of Use agreement.
